JURISDICTION 12. The Republic of Actaeon and the Kingdom of Rheia are both parties to The 1977 Pulp Mill Agreement, the 1978 Janus River Regional Agreement, the Statute of the ICJ and the 1969 Vienna Convention on the Law of Treaties. 13. The Republic of Actaeon has brought this claim in order to uphold its specific right under articles 5,6 of The 1977 Pulp Mill Agreement, articles 2,20 of 1978 Janus River Regional Agreement, and International Law Commission’s 2001 Draft Articles on the Responsibility of States for Wrongful Acts of Vienna Convention in 1969. 14. The Court's jurisdiction is based on Article 36(2) of the Statute of the ICJ. Article 36(2) of the Statute of the ICJ provides that ‘The Government of Actaeon declares that it recognises as compulsory ipso facto and without special agreement, in relation to any other State accepting the same obligation, the jurisdiction of the International Court of Justice in conformity with paragraph 2 of Article 36 of the Statute of the Court. This declaration does not apply to any dispute concerning natural resources.’ The Article 36(2) declaration of Rheia, lodged in 2003, relevantly provides: ‘The Government of Rheia declares that it recognises as compulsory ipso facto and without special agreement, in relation to any other State accepting the same obligation, the jurisdiction of the International Court of Justice in conformity with paragraph 2 of Article英语论文网 【http://www.51lunwen.org】 36 of the Statute of the Court.’ 15. Article 36(2)establishes two requirements for the ICJ to have jurisdiction. First, the Applicant must be a party to the Optional Protocol. Second, there must be a dispute "arising out of the interpretation or application" of the Vienna Convention on Wrongful Acts. According to this Court's longstanding jurisprudence, these jurisdictional requirements must be met as of the date of the filing of the Application, which is the critical date for the Court to determine its jurisdiction. Both requirements are met here. 16.First, on 31 September 2007, when the Application was filed, Actaeon, Rheia and Thanatos are parties to the 1969 Vienna Convention on the Law of Treaties, and all three states have publicly declared that they regard the International Law Commission’s 2001 Draft Articles on the Responsibility of States for Wrongful Acts as forming part of customary international law. 17. Second, in May 2007, there existed dispute between two states, the Republic of Actaeon and the Kingdom of Rheia, concerning a pulp mill on the River Janus. Actaeon wishes to bring proceedings against Rheia in the International Court of Justice in relation to the dispute. The Governments of Rheia and Thanatos publicly announced in June 2007 that they would begin decommissioning the Janus Pulp Mill, with the mill to cease operation by January 2008. 18. The Republic of Actaeon and the Kingdom of Rheia have agreed that if any dispute arises between the
