Brief introduction about Business Law on Legal Convergence

1. Introduction
Convergence means the tendency of societies to grow more alike, to develop similarities in structures, processes and performances. Legal convergence also is explained as legal evolution. It means different legal systems in different countries come to be more alike and develop similarities in structures, processes and performances. In short, legal convergence means a general resemblance between laws in different countries. There are three types of convergence: formal, functional and hybrid . This paper will discuss the difference of the three types of legal convergence by comparison of the application of the insolvency law of IMF in Indonesia and Korea.

The reasons for legal convergence may caused by harmonization, globalization or political compromise in order to get a particular outcome . Convergence may imply different things and cause different effects . Convergence may develop towards one rule or system or create a hybrid. Formal convergence means to adapt a new legal system. With a functional convergence, legal rules may not have converged, but to opt for certain rule . Hybrid convergence is the combination of these two kinds of convergence, and the legal convergence in most countries acts in the form of hybrid convergence most of the time .
