t 1988. The 1988 Act was a consolidating Act which brought all the diverse laws relating to copyright under one umbrella law. The UK law on copyright has been supplemented and amended by the Copyright and Related Rights Regulations 2003. These regulations give further effect to the EC Copyright Directive and came into force on the 31st October 2003.
When is copyright created?
As soon as an idea is put into a material form, that is on paper and pen, in a book, in a CD, in a DVD, in a broadcast, in sheet music, as a film, as a sound recording and as an internet page. Normal rule is that copyright lasts for 70 years after the death of the author. Computer generated literary, dramatic, musical and artistic work are protected for 50 years after death. Sound, broadcast and cable programmes are protected for 50 years from date of release. Typographical arrangements are protected for 25 years from the end of the year of publication. Databases that are the result of ‘substantial investment,’ in financial, human or technical terms, and substantial in terms of quality or quantity are protected for 15 years from the end of first publication. Note that databases are given a very narrow scope of protection since it is reasonable to assume that the monopoly granted to the producer of a database may frustrate legitimate scientific or educational use of the information.
