The fifth area of the sanctions that has to do with financial dealings with Sudan talks about what type of financial deals the United States can make with Sudan. This area prohibits any U.S. banks or any U.S. person from making any type of financial deal with the non-specified areas of Sudan. As long as the transactions do not involve non-specified areas of Sudan or the government of Sudan does not have any type of interest in the transaction, it is permitted that Sudanese banks in the specified areas of Sudan may make transactions with the United States. [16]

 

The sixth and final are of the sanction laid out in executive order 13412 labels the actions that are permitted by any non-governmental organization and any international organization. This area of the sanctions allows any NGO’s or international organizations that are involved in religious or humanitarian assistance in the specified areas of Sudan to be involved without needing any type of license. In respect to the non-specified areas of Sudan the NGO’s may assist in the religious and the humanitarian issues of these areas with the proper license from the Office of Foreign Assets Control. [17]

 

If any of these areas of the sanctions are violated the United States gives themselves the right to impose penalties on these violators. The monetary penalty for violating these sanctions range from fines anywhere up to one million dollars. Any person that violates these sanctions could also face up to twenty years in a federal jail. [18] These sanctions were implemented on three Sudanese individuals that were involved in the crisis in Darfur along with thirty one companies that are owned by or controlled by the Sudanese government. They put in place to put more political pressure on the Sudanese government and Khartoum to end the violence in Darfur along with supplementing prior sanctions by the United States on Sudan since 1997. [19]

 

Along with these economic sanctions on the government of Sudan, a more direct approach of solving the crisis in Darfur was made by the United States, the United Nations and the African Union. For those leaders who did not sign the 2006 Darfur Peace Agreement the international community welcomed the signing of resolution 1769. [20] On July 31, 2007 the United Nations Security Council passed resolution 1769. Through the agreement of resolution 1769 the United Nations and the African Union will join together as a hybrid peacekeeping force that will take over the peacekeeping mission of the African Union in Darfur.
