CHAPTER TWOLITERATURE REVIEW

The present study aims at finding how the language used in legal publicity documentscan influence the legal cognition of migrant workers, and if some modifications to theoriginal language can improve the cognition level of them. It is a study that requiresthe theories from different areas, such as those theories from legal, psychological, andlinguistic area. So it is necessary to review all these relevant theories in this chapter.

2.1 Studies on Legal Publicity from Legal Perspective
As the issue of migrant workers becomes increasingly urgent these years with thegrowing population of them in big cities, many legal scholars and practitioners havepaid their attention to improving the legal publicity work for the migrant workers. Inthis part, the importance and present problems of legal publicity to migrant workersand the suggestions made by them will be discussed.Latest statistics from 2014 Monitoring Survey on Migrant Workers in China given byNational Bureau of Statistics of PRC shows that there are total 274 million migrantworkers in China, over 100 million of whom are all under 25 years old. And thenumber keeps growing every year. For the fact that most of the migrant workers arenot highly educated, they are more vulnerable to the willful infringement of theiremployers who will take advantage of their ignorance of the legal knowledge. Anddue to the lack of legal consciousness, they will not go for legal aid when such torthappens, but resort to violence instead, thus making more problems to the society.In 2006, Chinese government had made the legal publicity work to migrantworkers a priority of the Fifth Five Year Plan of Legal Publicity and Education Project.And with the development of society, migrant worker issues get more attention fromlegal scholars. They all come to realize the importance of legal education to them.Many articles are about the need of legal education to migrant workers. Song Bona(2015) reckons that legal publicity work to migrant workers is urgent work for theconstruction of a Harmonious Society; Ning Jun (2006) hold that it’s not only theneed of the Harmonious Society, but also the need of an All-around Development forhuman-beings and at the same time also the way to protect the lawful rights ofmigrant workers. All the scholars had made it clear that legal publicity to migrantworkers is of great meaning. Chen Li (2009) discusses the current situation anddilemma of immigrant workers and points that public legal education can serve asinternal motivation to enhance immigrant workers’ legal awareness and rightsawareness.
