Chapter One Project Survey

1.1 Project Description

This project report is based on the translation of Measures on Social Assistance ofJiangsu Province. To have a better understanding of this project, the author needs to make athorough analysis of the background, structure and content of this project and the stylisticfeatures of the source text before the work of translation starts.

1.1.1 Project Background

In order to exhibit the achievements in construction of China’s socialist legal system,make it convenient for people at home and abroad to comprehensively understand China’slegal system in amoresystematicwayandkeeppromisesmadewhenChinajoinedtheWorldTrade Organization, the State Council issued the Notice by the General Office of the StateCouncil on Translation and Examination of Official Translation of Administrative Laws andRegulations (hereinafter referred to as Notice) in 2003. In response to the Notice, JiangsuProvince commenced the work of translation of the local regulations, aiming to provide astrong legal basis for the exchanges between Jiangsu Province and other areas from all overthe world.And the author’s project Measures on Social Assistance of Jiangsu Province, a setof local regulations formulated by the people’s government of Jiangsu province in 2014 inorder tostrengthensocial assistanceandguaranteethebasicliving ofcitizens, isanimportantpart in construction and improvement of China’s legal system. The translation of theseMeasures will help people from other countries to Jiangsu Province learn more about therelevant social policies, therebyhaveabetter understandingof China’ssocialist legal system.

1.2 Stylistic Features of the Source Text

To serve a very special purpose, legal language has developed particular linguisticfeatures of its own. These features have had profound influences on legal translation andmade it distinctive from other categories of translation. Generally speaking, formalizedlanguages are usually found in a legal text, where words and expressions used arecharacterized by authoritativeness, accuracy and professionalism. To further understand thesource text and better prepare for the translation work, stylistic features of the source textwill be analyzed from both lexical and syntactic perspectives.

1.2.1 Lexical Level

Laws represent the wills of the ruling class, which, therefore, have the force to regulateconducts. Thus, to maintain solemnity of laws, words and expressions used in legal textsmust be authoritative, accurate and formal, among which, legal terms, a set of vocabularywith particular meanings related to law, are quite common to be found.As a legal text, thereare a great number of legal terms found in the source text, such as “民事行为能力人”, “限制民事行为能力人”, “截留、挤占、挪用、私分” and “责令”.Another distinctive featureof legal language at lexical level is “the complex and unique legal vocabulary found indifferent legal languages” (Cao, 2007: 20), which means that under very different culturalbackgrounds, different legal languages have different and unique legal vocabulary of theirown.
