Abstract:
This article presents information about a survey, conducted by MIP which set out to discover what brand owners really think about key issues such as which countries offer the best and worst protection, how to enforce rights and what qualities to look for in outside counsel. Forty in-house counsel responded to the detailed questionnaire, to give the most comprehensive survey of trade mark attitudes ever compiled. The survey covered five main areas: trade mark protection, domain names, harmonization, enforcement and outside counsel. What do brand owners want? More Madrid Protocol member states; cheaper trade mark protection; better enforcement in China; higher penalties for infringers; no more internet TLDs; and outside counsel with local knowledge.
Those are some of the key findings of the first MIP trade mark report, published here. In a unique survey, we asked representatives of some of the world's leading brand owners to tell us (anonymously) what they think about topical issues ranging from the Madrid Protocol to their hiring policy. Forty in-house counsel responded to our detailed questionnaire, to give the most comprehensive survey of trade mark attitudes ever compiled.
The survey covered five main areas: trade mark protection, domain names, harmonization, enforcement and outside counsel, and the findings of each area are discussed in turn. We also asked in-house counsel for details about their company and their approach to brands: these findings are summarized on the final page. Five short articles and interviews over the next few pages examine in depth some of the most interesting trends and topics revealed in the survey, and a selection of charts illustrate some of the findings. We also invited respondents to comment on some of the issues raised in the report: a selection of quotes is printed on page 34.
