The Scenario
A dispute has arisen between two states, the Republic of Actaeon and the Kingdom of Rheia, concerning a pulp mill on the River Janus. Actaeon wishes to bring proceedings against Rheia in the International Court of Justice in relation to the dispute.

The River Janus has its headwaters in the mountainous regions of Rheia and flows across the border into Actaeon. Since 1980 a pulp mill has operated on the River Janus in Rheia, near the border with Actaeon. The pulp mill is owned and operated jointly by the Rheia Paper Company (RPC) (a company wholly owned by the Rheain Government) and Thanatos Timber Inc (TTI) (a company wholly owned by the Government of Thanatos). The Federated State of Thanatos is a nearby country that shares no border with Actaeon or Rheia.

The Janus Pulp Mill was constructed, and is now being operated, pursuant to a treaty entered into in 1977 between Rheia and Thanatos. The 1977 Pulp Mill Agreement relevantly provides as follows:

The Governments of the Kingdom of Rheia and the Federated State of Thanatos (the ‘Contracting Parties’) desiring to promote economic prosperity through the sustainable development of natural resources,

Have agreed as follows:

Article 1
The Contracting Parties will construct a paper pulp mill (the ‘Pulp Mill’) on the River Janus in Rheia pursuant to the technical details set out in Annex A to this Agreement.

Article 2
Unless and until the Contracting Parties otherwise agree, the Pulp Mill will be jointly operated by government instrumentalities of the Contracting Parties.

Article 5
The Contracting Parties are committed to protecting the riverine environment of the River Janus from any significant damage caused by the construction or operation of the Pulp Mill.
Article 6
The Contracting Parties hereby assume joint responsibility for any significant damage caused to the environment of another state, or of any area beyond the national jurisdiction of the Contracting Parties, as a result of the operation of the Pulp Mill.
