BACKGROUND

Of all the legal issues associated with Doing Business Overseas, insurance is the one that grew up specifically in connection with the needs of merchants seeking protection of their investments in international business.

Two thousand years ago the international shipping centre of Rhodes in the eastern Mediterranean, had developed the rule of general average in which where goods were lost at sea, then all the merchants who had shipped goods in that particular voyage, would pay a proportionate share of the loss of any one of their number who lost goods that had to be jettisoned overboard.

Roman society had the equivalent of life insurance whereby friendly societies would exist in which members could pay instalments into the fund which would pay up on their death to allow them a decent burial.

The modern insurance market seems to have started in North Italy among the Lombard merchants there in the 13th and 14th centuries. By the 14th century, insurance had developed as a stand alone contract and one that permitted outside investors to risk their capital in ventures in return for a profit.
