(1) Introduction
1. This paper provides an overview of lawyers, courts, sources, litigation under the Civil Procedure Rules (the ‘CPR’), and arbitration.

We begin, in section (2), with a brief description of the English system of courts, lawyers, and its general legal methods. Section (4) concerns the main aspects of the English system of civil procedure. In section (5) we will note the main features of the English Arbitration Act 1996.

2. This short statement is intended to delineate the essential features of thissystem. There is a very useful description of the court system in eachyear’s issue of Judicial Statistics3and in specialist works.4

Civil Courts
3. The two courts of first instance in civil matters are the county courts andthe High Court.5Small claims and actions for moderate amounts mustbe commenced in the county courts. These are located in many citiesand towns.6Actions for larger sums proceed to the High Court, whichsits in the main provincial cities and in London. There is no longer aright to appeal from a first instance decision (see further Appendix II at45 below). Instead, permission to appeal must be obtained from the firstinstance court or from the relevant appellate court. In this way, appealsare controlled. The Court of Appeal hears appeals from judgments madeby High Court judges. Final appeal to the House of Lords occurs inrelatively few actions each year.

The Ministry of Justice and the Lord Chancellor have overallresponsibility for the administration of justice in civil and criminalmatters.7Judges are selected from the ranks of practising solicitors orbarristers by the Judicial Appointments Commission.8Traditionally,High Court judges have been former barristers.9The distinctive featureof the English judiciary is that appointments are made only after alawyer has gained extensive experience of practice as a solicitor orbarrister. Judges sitting in the county court are known as ‘districtjudges’ (or ‘deputy district judges’), or ‘circuit judges’, or ‘recorders(civil)’.10The High Court is composed of three ‘divisions’: the Chancery

Division, Family Division, and the Queen’s Bench Division.
