The Need For Equal Employment Opportunity Law Essay
Equal Employment Opportunity is a term that will affect approximately every American that enters the workforce. In the workplace, it is based on making sure that work environments are free from prohibited discrimination and harassment, and gives working Americans equal opportunities for promotions, training and development. In the job hunting and application process, it attempts to make sure that all job applicants, males or females, no matter what race, have a fair chance in a hiring process.
This means having workplace and company policies, rules, and practices that are fair and do not favor certain people. It also means not have procedures in place that give people a disadvantage because they have a certain disability or belong to a certain group. With these policies and rules, it ensures that all employees, or future employees are valued and respected, and have the opportunity to grow to their full potential and develop a career path of their own choice. The following paper will give an overview of two important legislations of Equal Employment Opportunity, the American Disabilities Act, and the Civil Rights Act of 1964.

The Americans with Disabilities Act was passed July 26, 1990 as a public law and became effective on January 26, 1992. It is a federal legislation that opens employment opportunities to the millions of Americans with disabilities. The law was written to form a balance between the citizens with disabilities needs and the ability of private and public business to respond with the opportunity to employ these individuals. It was intended to eliminate unlawful discrimination and even the workforce for disabled individuals. It prohibits employers with 15 or more workers from discrimination against qualified individuals with disabilities, with regard to applications, hiring, discharge, compensation, advancement, training, or other terms, conditions, or privileges of employment (Dessler pg. 36). The American Disabilities Act also says employers must make 'reasonable accommodations' for physical or mental limitations unless doing so imposes and 'undue hardship' on the business (Dessler pg. 36).
The American Disabilities Act does not specify a certain disability. The Equal Employment Opportunity Committee state that someone is disables when he or she has a physical or mental impairment that substantially limits one or more major life activities. Some disability impairments include and physiological disorder or conditions, cosmetic disfigurement, or anatomical loss affecting one or more of several body systems, or any mental or psychological disorder.
