2.1    Researches on Legal Text Translation

2.1.1   Review on Translation of Legal Texts

With  a  wide  distribution  of  research  field  in  legal  texts,  the  domestic  papers  focus  on legal  translation  and  English  teaching.  Overseas  researches  attach  great  importance  to  the analysis of legal text, and legal semantic research as well as legal pragmatic study are also hot fields in these years.

In  the  translation  of  legal  texts,  both  foreign  and  domestic  studies  are  abundantly conducted.  Many  foreign  scholars  tend  to translate  legal  texts  literally  from  very  beginning. The principle of legal equivalence was proposed by Beaupré [10], which takes the legal effects of  translated  texts  in  the  target  culture  into  consideration.  Scholar  Sarcevic [11]  treated  legal translation as a communication act which happens within the mechanism of law. She studied legal  translation  from  the  perspective  of  functionalism.  In  accordance  with  the  principle  of legal equivalence,  legal translation seeks to achieve  identity of  meaning between source and target texts, i.e. identity of both propositional content and legal effects according to Sager [12]. Neubert and Shreve [13] believed that legal translation should reflect the author’s intent. They thought the  intention  of  the  author  should  guide  the  translator  in  legal  translation.  Varo  and Hughes [14] worked  on  practical  problems  regarding  legal  jargon  and  legal  terminology  and provided with practical techniques to deal with them.
