Sarcevic, however, disagrees with Reiss’s classification and she notes in her book New Approach to Legal Translation that “Generally speaking, legal texts can be divided into the following three groups according to their function: 1) primarily prescriptive. 2)primarily descriptive but also prescriptive, and 3) purely descriptive” (Zhao 2017:10). 

2.  PROCESS DESCRIPTION

2.1  Preparation of translation tools

According to Li and Zhang (2006), a legal translator must be an excellent reader who can fully comprehend the implication of the source text. Therefore, before embarking on the translation project, the translator mainly chose Longman Dictionary of Contemporary English the 5th Edition, Black Law’s Dictionary 8th Edition, Collins Dictionary of Law 2nd Edition, and English-Chinese Dictionary of Anglo-American Law as the main tools to decode the very meaning of English words and phrases that appear in the source text. Of course, in addition to the two dictionaries, the translator also seeks help from websites such  as https://www.baidu.com/, https://www.google.com.hk/, https://www.wikipedia.org/, https://www.bing, https://www.thesaurus.com/ and http://www.freecollocation.com/. As for the names of English, French or German origin that appear in the source text, the translator turns to name-translation handbooks published by Xinhua News Agency.

As for the Spanish grammatical conceptions or sentence constructions, the translator mainly resorts to the Español Moderno series, which are compiled by the Chinese Spanish expert Dong Yansheng, and other textbooks published in Foreign Language Teaching and Research Press. Besides, the translator resorts to websites like http://cn.esdict.cn/ and dictionaries like Diccionario Moderno Español-Chino Chino-Español in order to make sure that the translation in relation to the Spanish language is rendered correctly and properly.

2.2  Preparation of parallel texts

According to Nord (2007), traditional dictionaries and grammars often do not provide translators with sufficient or adequate information to find good solutions to some translation problems. For this reason, translators are recommended to resort to a variety of texts that are useful in source-text analysis and target-text production. Therefore, the translator deems it important to consult parallel texts with the aim to producing an accurate translation. 

Li and Zhang (2006) have stated that although legal translators are not legal experts, they should possess adequate legal knowledge. For this reason, the translator, first of all, takes A Course of Legal Interpreting, which is edited by Du Jinbang and Zhang Xinhong and published in 2006, as a guide book for court interpreting. This textbook not only provides court interpreting beginners with background information about court interpreting and useful vocabulary but also offers to learners’ exercises for interpreting skills and interpretation practice. In short, A Course of Legal Interpreting will help a lot during the translation process of the source text. Examples of terminology translations in the legal field are as follows:
