What significant differences exist between the criminal law and court procedures of the Islamic criminal law and the Australian criminal justice system? What similarities are there? What guarantees are furnished by Shari'a to the accused throughout the different stages of the criminal process? Is the judge bound to observe particular rules and modes of evidence in criminal cases? As a result of your findings above, to what extent might it be possible for the Australian and Islamic criminal justice systems to influence each other? To what extent would this be precluded by virtue of different sources and legitimising processes between the two systems?
