GENERAL INSTRUCTIONS: Please read these instructions carefully.
1. WEIGHT: This
assignment is worth 25% of the final mark in the subject.
2. DUE DATE: The assignment is due no later than Monday, 28 September 2009 at 2.00pm.
A penalty of 10% of the value of the assignment per day, or part thereof, will be deducted from the final mark awarded for the assignment if an extension has not been granted. If you need an extension of time you need to apply as soon as possible. The grounds for an extension are set out below at point 7.
3. LENGTH OF ASSIGNMENT AND FORMATTING INSTRUCTIONS:
The assignment is to be a maximum of 4 pages (1000 words) in length.
The assignment is to be presented in typed form on one side of A4 paper using Times New Roman 12-point font and using double line spacing. The margins of the paper (right, left, top and bottom) must be no less than 2.5cm.
The paper is not to include foot
notes, appendices or a bibliography.
A penalty of up to 10% of the value of the assignment may be deducted for failing to comply with the page limit and/or the formatting instructions.
4. PRESENTATION OF THE ASSIGNMENT:
All written work in the law school is required to comply with The Australian Guide to Legal Citation available on:
https://www.law.adelaide.edu.au/library/resources/style/.
Please read the AGLC before submitting your paper and make sure you comply with it. For the case analysis, you do not need to worry about the rules relating to referencing and footnoting. However, rules as to the use of headings and citation of cases may be relevant.
The assignment must be written in prose style (using complete sentences), adhere to grammatical rules, and use correct spelling.
5. MARKING CRITERIA AND GRADING:
Marks will be awarded for the following:
• Ability to answer the questions succinctly and clearly;
• Understanding of the principles of Statutory interpretation;
• Application of the principles of statutory interpretation to the problem scenario;
• Written communication skills, including logical and coherent structure;
• Quality of presentation: Spelling, grammar & punctuation.
The assignments will be graded as follows:
Fail 0-49
The answer fails to come to grips with the interpretation problem. It demonstrates scant knowledge of the common law and statutory rules of interpretation, and the paper fails to adequately apply these rules to the problem. The answer is poorly presented, with little evidence of an ability to construct a coherent answer using analytical and evaluative skills. The answer has problems with written expression and presentation, and contains numerous inaccuracies.
Pass 50-64
The paper demonstrates an adequate understanding of the interpretation problem. It demonstrates reasonable knowledge of the common law and statutory rules of interpretation, and shows some ability to apply the rules. The answer is adequately presented, and demonstrates a reasonable ability to construct a coherent answer using analytical and evaluative skills. The answer uses adequate written expression and is satisfactorily presented. It contains few inaccuracies.
Credit 65-74
The paper demonstrates a good understanding of the interpretation problem and a good knowledge of the common law and statutory rules of interpretation. The answer applies these rules to the
