China’s environmental impact assessment system was studied from foreign countries, gradually developed with Chinese actual conditions. In 1979, China promulgated the "Environmental Protection Law of the People’s Republic of China" (Trial) in first time provided for EIA. The relevant departments of State Council promulgated the “Environmental Management Approach of Infrastructure Projects” in 1981 and amendments in 1986, made specific provisions on China’s EIA system: all construction projects which impact in environment must conduct an environmental impact assessment, implement environmental impact report or the examinatioviiapproval system of reports; the projects without the approval will not be allowed to start. In 1998, the State Council promulgated “Environmental Protection Management Statute of Construction Project” defined comprehensive and detailed specific requirements on EIA as the first administrative regulation of environmental management of construction projects. In 1999, formally announced “Certificate Management Method of Environmental Impact Assessment of Construction Projects” provided the quality of the assessment agencies. In existing, there are 198 agencies of Class A, 721 agencies of Class B (the end of 2004).  In 2002, the State Council promulgated “Environmental Impact Assessment Law of People's Republic of China”, carried out a detailed mandatory provision of the environmental impact assessment.
Prevention is important than treatment. Prevent pollution at the source rather than spent great effort to improve environmental condition. Environmental impact assessment played the role of prevention. In developed countries, such as UK and US, EIA has pivotal position in the area of planning and construction. The environmental pollution in China trends seriously because that the EIA do not play the role to control strictly, allowing construction of heavy pollution industries. Both of legislation and implementation of EIA in China have many problems. The author is seeking to investigate the Chinese EIA system and propose several recommendations objectively by comparing the EIA system between China and UK.
