CONCLUSION

Elwyn Brooks White in his book, ‘Essay of E.B. White’, wrote:

Right to life does not mean mere existence but living life with dignity and all other basic necessities that go with it. Like air, water, food etc. pure environment is also a part of day to day human life and it is something which cannot be neglected. A lot of concern has been taken by the legislation and the judiciary to help people live a good life in hygienic atmosphere. But it is also the duty of all citizens as stated in Art.51A (g) to take care of the environment and keep its surroundings safe.

Right to pure environment cannot be said to be the duty of only the state but also the public at large as they are the ones who have to keep the surroundings clean. It would not only help the government but also help them lead a happy life free from diseases and sickness. Hence, public contribution is equally important in such matters.

The legislature has taken various measures for the preservation of the environment since the Stockholm Conference in 1972. Various Acts have come in for the preservation of air, water etc. so as to keep the environment clean. Yet, it must be observed that still very few cases have come up under these Acts. It’s not that the pollution is not occurring but people unaware about these acts do not come to the judiciary. Most cases that come up for pure environment are under Art.21 through PIL’s. Hence, more awareness is required to be spread on these Acts so that we get the benefit of pure environment.

The concept of sustainable development has also emerged on a huge scale so as to preserve the environment for future generations. These fears have started to set in due to the high scale pollution being done by people at large, directly or indirectly. This is an issue of huge concern now as people fear if the future generations can get the benefit of pure environment. The era of Global Warming has come before us which may mark the end of huge chunk of land area of the earth. Hence, we need to take all measure in helping reduce pollution, else there might not be much left later.

It is good to see that all countries have started taking measures in order to reduce pollution and judiciary elsewhere has also played an important role in the process. Almost all countries have given the right to pure environment either directly or indirectly in their respective Constitutions. Even UN has started taking drastic measures to preserve environment and has included in most of its conventions. It has also undertaken various programmes to spread awareness on these issues.
