rationale is that Indonesia had not become member of International Ocean Tuna Commission (IOTC), a commission that controls the exploitation of tuna fish. As a result of not being a member of IOTC, Indonesia tuna fish harvested from the Indian Ocean are accused to be illegal. The potential loss for the embargo was significant since 60-70 percent of tuna export went to Japan.

Each members of EC agrees to set up common NTM for EC. One identified problem for Indonesia is that some products exported to the EC experience different in market accessibility to European market vis-à-vis EC members. The Indonesia government refused this imposed regulation, because the product had passed port of entry review and has put up for sale.

4.4 Country Analysis

Along with the decreasing in tariffs measure across countries, the non tariff measure has encountered a significant increase. As discuss in the previous section, i.e. classification of NTMs, there are different types of NTMs.

In Indonesia, first of all, all the imports are subject to para-tariff measures: value-added tax (VAT) of 10 per cent as well as income tax of 2.5 per cent for licensed importers and 7.5 per cent for other importers. Moreover, prohibitions are applied to most of the tariff lines of paper and paper products (nearly 90 per cent), chemicals and chemical products and general/electric machineries (100 per cent); prohibited imports include printed materials such as books, magazines, leaflets, newspapers in Chinese in terms of moral hazard, chemicals and chemical products in terms of national security, colour photocopy machines and used machinery, equipment and other capital goods. In addition, non-automatic licensing is applied to about 60 per cent of the products of plastics and rubbers and 70 per cent of transport equipment. Similar to other countries, food industries are likely to be subject to multiple types of technical regulations such as testing/inspection/quarantine requirements, SPS measures and health/sanitary regulations and quality standards, sometimes combined with non-automatic licensing.
