1.1Why a Development Control Plan?
This Development Control Plan (‘DCP’) has been prepared to provide clear objectives anddetailed planning controls to encourage quality urban design, a 留学生论文代写high level of residential amenityand environmental sustainability in residential development in the Wollongong Local GovernmentArea (LGA).This DCP has been prepared and adopted by Council in accordance with the provisions of theEnvironmental Planning and Assessment Act 1979 and the Environmental Planning andAssessment Regulation 2000.

1.2What is the DCP called?
This plan may be cited as the City of Wollongong Development Control Plan No.49 – ResidentialDevelopment (‘DCP No.49’).

1.3Where does the DCP apply?
This DCP applies to all land covered by Wollongong Local Environmental Plan 1990 (‘LEP 1990’)and Wollongong City Centre Local Environmental Plan 2007. It applies to residential developmentthroughout the Wollongong Local Government Area.The plan provides Council’s standards for a range of residential development on both residentialand non residential zoned land including:􀁸 Infill residential subdivision;􀁸 Subdivision of non-urban and environmental protectionzoned lands;􀁸 Dwelling-houses and ancillary residential structures inenvironmental protection and non urban areas;􀁸 Dwelling-houses and ancillary residential structures in urbanareas;􀁸 Dual Occupancy and granny flats;􀁸 Multi dwelling housing;􀁸 Residential apartment buildings;􀁸 Mixed use development; and􀁸 Integrated housing.

1.4How does the DCP relate to other plans and policies?
NSW planning legislation, namely the Environmental Planning and Assessment Act, 1979 (‘theAct’) incorporates provisions relating to State, regional and local planning instruments. StateEnvironmental Planning Policies (‘SEPPs’) and Regional Environmental Plans (‘REPs’) mayapply to the land to which this plan also relates. Where this is the case, the statutory provisions ofthe SEPP or REP will prevail over this DCP, unless otherwise stated in any Local EnvironmentalPlan applying to Wollongong.

Local Environmental Plans apply to the land to which this DCP applies. These are local levelstatutory plans that establish land use zones, objectives and broad controls for developmentwithin the local government area. This DCP supplements the provisions contained in LocalEnvironmental Plans. Where an inconsistency between plans occurs, the LEP will prevail.
Site specific development control plans may supplement the general controls of this DCP. In theevent of any inconsistency between this DCP and a site specific development control plan, thecontrols of the site specific plan will apply.
In the event of an inconsistency between the Wollongong City Centre Development Control Plan2007 and this Development Control Plan, the provisions in the Wollongong City CentreDevelopment Control Plan will prevail.

1.5 When did the DCP come into force?
This plan was adopted by Council on 3 April 2006. The provisions of this plan came into force on10 April 2006.This plan was reviewed in 2007 following 12 months of operation and an updated DCP wasadopted by Council on 3 September 2007 and came into force on 8 September 2007.

1.6 How is the DCP used?
