· fairly and lawfully processed;
· processed for limited purposes;
· adequate, relevant and not excessive;
· accurate;
· not kept longer than necessary;
· processed in accordance with the data subject's rights;
· secure;
· not transferred to countries without adequate protection.

The U.K. Act will apply if a person is ‘established’ in the U.K., i.e. ordinarily resident, a U.K. incorporated body, partnership or unincorporated association or have an office, branch or agency which carries on any activity or a regular practice in the U.K. Also, if a person is not established in the European Economic Area but uses equipment in the U.K. for processing data (unless the information is merely in transit, for example if the information is routed over the Internet via a U.K. node).
 
There are certain conditions that are set out in Schedules 2 and 3 which are relevant for the processing of personal data, and so-called sensitive data, fairly and lawfully. In relation to electronic transactions, sensitive data, which relates to matters such as ethnic origin, political opinions and sex life, are less likely to be an issue. But personal data, which is defined widely as information about identifiable living persons, is as little as a name. In order to comply with the first principle, the data subject must have given his consent to the processing, or more significantly for e-transactions, the processing is necessary for the performance of a contract to which the data subject is a party, or for the taking of steps at the request of the data subject with a view to entering into a contract. There is a further relevant condition which is that the processing is necessary for the purposes of legitimate interests pursued by the data controller or by the third party or parties to whom the data are disclosed, except where the processing is unwarranted in any particular case by reason of prejudice to the rights and freedoms or legitimate interests of the data subject.

The data user in the U.K. must register to process data as it is an offence not to. Normally registration is for one or more ‘purposes’, but the use of the Internet is not a purpose, but a means to facilitate another purpose, such as marketing and selling.
Data Protection and the Internet

Particular issues of data protection in the digital age include certain E-commerce practices, such as:

 Using software to collect information such as click stream  data which provides a trace on the web sites visited by the  surfer and the dates of any visits

 Information about the type of computer and software used  by the surfer and keywords typed into Internet search  engines.

 Surreptitious collection of email addresses from chat rooms  and visitors to web sites.

 The rise of mobile phones and the spectre of location based  advertising and services
