though, Qantas declined in international market. the Qantas's the half-yearly results to December 2010 provided a pre-tax profit of $417 million with revenue of $7.6 billion and a cash balance of $3.3 billion (Rick 2011). That announcement further angered the union, when they still had negotiation about job-cut and salary problems with Qantas. As a result, they decided to make more actions in order to get firm attention. Qantas was trying to seek help from government. However unions often refuse to support any one political consistently and lobby all parties to support its political agenda as an exchange of supporting in election (Bray et al. 2011, p. 215). To ensuring still get support from Union in next election, government adopted the attitude of silence which leaded to grounding issue.

Being a model western liberal country, the power of state is separated into three parts, legislature, judiciary and executive. Each part plays different roles and has its own effects on industrial relationships (Bray et al. 2011; Moore 2009 & Singer et al. 2011). As a federation, the executive power is operated at state, territorial and federal levels. In this industrial strike, the coverage is nation-wide. So single state or territorial could not govern all disputes and only federal can coordinate all aspects. In federal level, the Prime Minister and Minister of employment and workplace Relations have statutory right to intervene in industrial relations disputes before FWA. But in this industrial action, cabinet did not using the power upon Fair Work Act to terminate this action, instead they leave this to the industrial umpire to decide. So people question the inaction of cabinet in this event. Nevertheless, Prime Minister, Julia Gillard (2011) declared the government's action is absolutely right in dispute. She explained the reason why government did not give the order directly upon the Act is 'using a section that has never been used before would have put us in a world of legal doubt' (Dziedzic 2011). As a result, the government had as application to FWA and left the issue to industrial umpire and hope to get what they to.

The industrial umpire which made the final order in this event is FWA. This industrial relation statutory agency is established by Fair Work Act. 'Fair Work Australia is considered to be more accessible to workplace through Australia, so it can respond more quickly to resolve dispute' (Bray et al. 2011, p. 136).
