The  last  part  of  The  Fifth  Amendment  to  the  Constitution  of  America  restricts  the government’s  right  by  stating  that  “nor  shall  private  property  be  taken  for  public  use, without just compensation.” The government regards condemnation as an important way to  exercise  administrative  rights  on  the  land.  The  restriction  of  private  property competes  against  its  protection  during  the  process  of  condemnation.  The  judgments involving condemnation herein mean the verdicts dealing with the disputes arising from the government’s condemnation. Facts about the action of condemnation are established, the  disputes  are  discussed  with  reasoning,  and  decisions  are  made  in  the  judgments involving  condemnation,  which  clearly  embody  how  private  property  is  dealt  with  in accordance with law.

CHAPTER TWO   LITERATURE REVIEW 

2.1 Overview 
The  present  part  will  present  a  panorama  of  studies  on  judgment  documents,  genre analysis  as  well  as  mood  and  modality.  The  judgments  involving  condemnation,  so  far, are  more  a  legal  research  topic  than  a  linguistic  issue.  Therefore,  quite  limited  relevant materials could be seen in the linguistic field. The resources at hand, however, throw light upon the present study with sufficient fundamental elements. The traditional methods of genre  analysis  can  make  a  positive  contribution  to  the  present  study  to  interpret  and explain the genre of the judgments involving condemnation.
