bsp;SFL) and North American New Rhetoric Studies (hereinafter referred as to NR) give descriptions and explanations from the perspectives of discourse structures, communicative purposes and society constructions. Combined with pedagogy practice, genre analysis theory developed different genre pedagogy theories, which are breath of fresh air to the further development of genre analysis. On the basis of the definition and characterization of genre by Swales and Bhatia, ESP shifted its focus onto the objective description of linguistic features as well as the exploration of communicative purposes of academic and professional discourses. In order to take a closer and clearer look at the changes and differences showed in language use when discourse achieves its communicative purposes, Swales (1990) establishes instructive moves and steps, which lays a solid foundation for ESP discourse analysis and pedagogy. ESP stresses the structural elaboration of the genres through moves, steps and linguistics signals instead of through functions of texts in their social contexts. In terms of Chinese judgments, ESP scholars may divide this genre into five moves: Heading-Facts-Grounds-Body-Ending. And each move is composed of several steps, all of which serve to meet the purpose of settling disputes. Bhatia (1993) utilizes standard rhetorical and functional
methodology to insightfully analyze such sample genres as product and self-promotion letters, research article abstracts, academic introductions, legislative provisions and legal cases. The descriptions and explanations of the two legal genres are fairly rich and valuable.
