Abstract摘要

特别和差别待遇条款是世界贸易组织对发展中国家和最不发达国家的优惠待遇。 作为“多哈发展议程”最重要的议题之一，特区和差别待遇得到了世贸组织成员的广泛关注。 特区待遇成为WTO处理经济发展问题时遵守的基本重要原则。 但是，尽管越来越多的成员意识到特殊和差别待遇的重要性，但在执行这一规定方面仍然存在各种问题。 本报告的目的是研究实施过程中的问题，实施可行性和资质。Special and differential treatment provision is the preferential treatment given to developing and the least developed countries by World Trade Organization. As one of the most important themes in Doha Development Agenda, special and differential treatment gets wide attention from WTO members. Special and differential treatment has become a basic important principle abided by WTO when handling the economic development issues. However, though more and more members realize the significance of special and differential treatment, there still exist various problems in the implementation of this provision. The aim of this report is to research the problems in the implementation process, enforceability and eligibility of S&D.

1.1 Background 
Along with the rapid development of global economy and wide recognition of the significance of cooperation by various countries, the most important international organization World Trade Organization has the decisive influence on current international trade. As for every country or region which planning to be integrated into global economy, there is no doubt that WTO is the most important rule maker and economic order builder. Therefore, researching and familiar with various rules of WTO becomes increasingly significant. Among all the members of WTO, there two-thirds countries belong to undeveloped countries . In consideration of this fact, whether WTO can achieve its expected goal and make great contribution to development of global economy is decided by if its provisions and rules adequate in assisting the integration of these WTO members undeveloped countries  into the multilateral trading system..................
