Abstract

E-Commerce and Data Protection
  
Personal information is regarded as the most valuable resource in 21 century. It can be used to help government make important decisions and to generate business profits.

Why there are so many illegal business organizations collect and sell personal information? That’s because personal information have huge business potential value. Thus, government should make a balance between protecting legal personal rights and promoting data flow when devising the new, omnibus privacy law. It’s necessary to not only guarantee data subjects’ freedom and basic human rights but also to give data processors fair opportunities to use these resources.

The common use of personal information can be divided into commercial and non-commercial intentions, and both of them may cause damage to data subjects, psychologically and materially. At the present time most of these harmful actions are conducted because of the popularity of Internet technology. On one hand variety kinds of computer network and communication technology provides advantage methods of collecting and utilizing personal information; on the other hand, in China there is lack of relevant legislation about how to regulate personal data utilization, especially commercial action. It’s apparently business organizations may try every effort to obtain personal data for their own commercial interests, such as targeted advertising, even if it’s beyond proper extent.

 【摘  要】个人信息被誉为21世纪最有价值的资源，它不但可以为政府决策提供依据，并可以被商业利用产生利润。
 
 商业机构有动机采集和转卖个人信息，说明个人信息具有很大的商业开发价值。因此，在开展个人信息保护工作时，要特别注意做到保护个人合法权益和促进信息流动之间的平衡，既保护当事人的人权和自由，同时也能使信息处理者合法、合理地利用个人信息资源，由此促进经济的发展和社会的进步。
 
 个人信息的利用主要有商业性利用和非商业性利用两种，这两种都存在侵害个人信息的情况。目前大量侵害个人信息的行为主要是在网络普及以后，利用网络的便利进行的。一方面，计算机网络等信息通讯技术极大地便利了个人信息的收集和利用；另一方面，我国缺乏相关法律规范个人信息的利用尤其是商业利用行为，商业机构为了从个人信息中谋取商业利益，极易超出正当的界限收集与利用个人信息。
