W Code of Ethics is that it is discriminatory. The policy discriminates against persons based on their sexual orientation. The military allows for heterosexuals to talk about and engage in heterosexual acts. However, it does not allow the same for homosexual and bisexuals. This comes as a surprise, as the military has always leaded the way for anti-discrimination. This takes into account the desegregation of the US Military in July 1948 by then- president Harry S. Truman by the issuance of Executive Order 9981 ('Truman Library - July 26, 1948: Executive Order 9981 Issued.').
Critical Issues
One of the critical issues of this policy is that the policy can cause an infringement on the service members' privacy rights. This can be shown in a recent case with the US Air Force. An Air Force member recently had contact, for reasons that did not concern her, with local law enforcement officials. The local police department noted a marriage certificate that indicated the service member was in a same-sex marriage. The local police department then notified the service members' command who initiated an investigation of homosexual activity by the service member. Subsequently the service member was discharged for the US Air Force (FOXNews.com, 2010). Since this case has come to light the American Civil Liberties Union has filed a complaint against the police department. This has also become an issue within the Pentagon, as they have begun a review of the DADT policy. This violation of the service members' privacy calls for an immediate change within the DADT policy. A change to the policy reflecting that third party reports should not be considered 'credible and articulated evidence' would prevent the violation of the service members' privacy rights.
A second critical issue to the DADT policy is that it is discriminatory in nature. This brings to question why the military is allowed to discriminate, however other government agencies and civilian employers are under the watchful eyes of the Department of Labor and the Equal Employment Opportunity program. The policy does not allow for service members of homosexual or bisexual nature to discuss or participate in such activities; while there heterosexual counterparts are allowed to do both. By not allowing these service members to talk about or participate openly in their chosen sexual orientation the service members have to either lie to, keep secret from or face discharge by the military. In addition, the military almost seems to foster a sense of deceit with the way the DADT policy is written. A change in the DADT policy needs to be made, in order to ensure that there are equal rights given to all, not just those outside of the military.
In brief, looking at the military throughout history, as stated above, the military has been at the forefront of setting new standards in antidiscrimination, antislavery and other such actions. The military, in leading the way, has allowed for a more 'opened mindedness' throughout the United States on these issues.
