However, the current legal translation progress is less than satisfactorycompared with translation in other fields as literature, science, technology andcommerce.Legal translation has its inherent complexity as it is not only about dealing withthe languages of Chinese and English, but also involves elements behind the language,such as legal systems, legal cultures and so on. There is a system of vocabulary, thelegal terms, to express the legal concepts in each legal system. The translation of legalterms is a most important part in legal translation, to some extent, the quality of legalterms translation decides whether the whole passage of legal translation is acceptableor not. The major difficulty for the translation of legal terms is that there are noabsolutely equivalent legal concepts in different legal systems.Considering the difficulty in translating legal terms, this thesis comes up with tworesearch questions, that is, How to convey the legal concepts of legal terms in aprecise manner from one language into another? How to effectively translate andtransmit legal cultures hidden behind legal terms so that the communication andinteraction concerning laws and regulations between China and western countries canbe more productive?Traditionally, the researches on legal translation are carried out throughcross-culture study, functional translation theory and comparative law study. However,the focus of legal translation study is to reach the “double transfer of language andlegal function” (Sarcevic, 1997:89). The previous studies emphasize certain aspects oflegal translation, but other aspects are ignored. From the perspective of Fillmore’sframe semantics theory, this thesis will endeavor to discuss how to translate legalterms by taking various elements such as legal systems, legal functions and legalhistory, into considerable account, and to employ frame analysis, which consists ofthe process of identification of the frame evoked by this legal terminology, selectionof the cognitive perspective, formulation of a preliminary list of frame elements, andretrieval of the legal term in the target language that can activate the same cognitiveframe, for the realization of the adequate translation of legal terms, some strategiessuch as matching frames, adjusting frames and borrowing frames can be made use of.
