Anti-Suit Injunctions and Forum Non Conveniens in Australian Family Law Proceedings

Although the notion of forum non conveniens has recently been productive in Australian family law, of not inconsiderable, if rather predictable, difficulties (so much so that care should be taken by potential litigants and their representatives when dealing with Australia; see, A and GS and QS (2004) FLC 93-199; State Central Authority v LJK (2004) FLC 93-200; JJT and CTT (2004) FLC93-198, B v B (Re Jurisdiction) (2003) FLC 93-136). At the same time, the use of anti-suit injunctions is hitherto largely unknown in the same area of legal activity. In the leading decision of the High Court of Australia in CSR Ltd v Cigna Insurance Australian Ltd (1997) 189 CLR 345, Dawson, Toohey, Gaudron, McHugh, Gummow and Kirby JJ pointed out in a joint judgment that:
'a court may grant an injunction to restrain a person from continuing or continuing foreign proceedings 代写留学生论文if they, the foreign proceedings, interfere or have a tendency to interfere with proceedings, pending in that court.' Further, such injunctions could be granted in the exercise of equitable jurisdiction where proceedings in another court, including a foreign court, were, according to principles of equity, vexatious or oppressive (at 393). In that latter context, as the leading Australian text on conflict of laws put the matter in reaction to forum non conveniens:
'the mere co-existence of proceedings does not constitute vexation or oppression. Foreign proceedings are to be viewed as vexatious and oppressive only if there is nothing to be gained by them over and above what they may be gained in local proceedings.' (PE Nygh and M Davies, Conflict of Laws in Australia (7th edn, Lexis Nexis, 2002), at 137; see also Bank of Tokyo Ltd v Karoon and Another [1987] AC 45, at 60 per Lord Goff)
Recently, the Anti-Suit Injunction and forum non conveniens have come graphically together in the area of family law in the decision of the Full Court of the Family Court of Australia in Dobson and Van Londen (2005) FLC 93-225, 2005 FamCA 479. In that case, the parties had married in 1998 in Australia and, between 1990 and 1999, had four children. For a short time in 2003, the wife and children moved to live, with the husband's consent, in The Netherlands. In 2003, the wife returned to live in Australia, but both returned to The Netherlands with an intention of permanently residing there with the children.
In March 2004, the husband filed an application in the Family Court of Australia where he sought final orders with regards to property matters and holiday contact with the children. The wife filed an appearance, sought to have the proceedings permanently stayed and, in the alternative, sought other orders. The wife then brought proceedings in the Amsterdam District Court, in which she sought divorce, spousal and child maintenance, and property settlement orders.
