Issues Faced By Indian Companies In United States

The purpose of this report is to highlight the different issues and non-tariff barriers that Indian exports face in the US. The report also suggests steps to be taken by concerned stakeholders.

Executive Summary

After several successive rounds of GATT negotiations, direct modes of protectionism such as tariffs have been more or less replaced by Non-Tariff Barriers (NTBs) and Non-Tariff Measures (NTMs).

Indian exports face a myriad of NTBs in the US.

In a survey carried out by CII, companies raised issues such as the absence of totalization agreement and the complexity of the Importer Security Filing Form and the Advance Cargo Declaration Rule. Restrictive standards, bankruptcy code, H1B cap and government procurement policies are some of the other issues that were raised.

Other issues identified by the Ministry of Commerce in their dynamic database for NTBs and NTMs have also been included.

At the national level, the government needs to establish testing and monitoring institutes that are accredited by international bodies, prepare risk evaluation reports to test whether the risk that a particular product/measure poses is significant enough to justify the high cost of compliance to the standards imposed by the importing country.

At an international level, the government should sign equivalence agreements with its major trading partners, play a more active role in international standardization bodies, ask for technical assistance from bilateral and multilateral aid agencies, stop the practice of destruction of consignments without retesting.
