本文是一篇商务英语论文，本文基于刘法公教授的理论观点和苏珊·沙切维奇教授的法律翻译理论，结合权威资料分析翻译问题产生的原因，最终提出以下三条翻译对策：（1）比较权威法律词典中的法律概念，寻找匹配术语；（2）查阅权威法律资料，选用专业术语；（3）选用英语法律文本中的对应术语，保持译名统一。 

Chapter One Introduction

1.1 Research Background

In the new era, legal translation turns out to be an inseparable part in China’s foreign-related legal transmission, thus attracting considerable attention in legal translation and research. In order to help English-speaking foreign investors, government officials, practitioners of legal profession and scholars to understand China’s laws and regulations correctly and exactly, a great number of China’s laws and regulations have been translated into English since 1978. The past decade has seen the rapid development of legal translation practice and research thanks to more and more scholars’ engaging in this field. 

So far, we can see substantial textbooks, monographs, and academic papers on legal translation published, mainly focusing on following four aspects: theories of legal translation, characteristics of legal language, principles or techniques of legal translation, and tactics of legal term translation (Li & Hu, 2006). It should be noted that the accuracy of legal term translation serves as a contributing factor to the reliability of international communication for it is central to the entire discipline of legal translation. However, by December 7, 2022, there only exist 52 CSSCI papers in CNKI themed with “legal term translation”, most not in a systematic way. Generally speaking, researches on legal term translation are only at the preliminary stage, and practical and academic opinions on it are much scattered.

1.2 Research Objectives and Significance

This research aims to achieve such two major objectives: (1) to find and analyze problems of C-E translated legal terms in Civil Procedure Law before digging out the root causes behind for necessary solutions, (2) to put forward concrete and feasible countermeasures against these problems to improve the quality of C-E translated version of Civil Procedure Law for global transmission.

Significance of this research lies in both theoretical and practical fields. Theoretically, this research has following two values. Firstly, the thesis further supplements professor Liu’s principle of consistency by taking the phenomenon that different Chinese terms with the same translated term into consideration. Secondly, this research supplements Susan Šarčević’s theory and theoretical points on legal term translation by taking the situation of exact equivalence into consideration and putting forward more concrete methods to seek functional equivalents. Also, this research further expands the application of her theoretical points.

Practically, significance of this research is elaborated in following three aspects: (1) to improve the quality of C-E translated legal terms in Civil Procedure Law, effectively guide C-E translation of legal terms in other similar legal documents, and facilitate standardization of legal translation; (2) to achieve precise international dissemination of China’s laws and get recognition and praise for the construction of China’s legal system; (3) to provide standardized and high-quality teaching material of legal translation.
